4. Does All Racquet Sports Share My Information with Third Parties?

6. Social Widgets.
The Site supports third-party widgets, such as Facebook, Instagram, and Twitter buttons on the website, that allow users to share articles and other information on different platforms. These widgets may collect your IP address, and which page you are visiting on the Site, and may set a cookie to enable the widgets to function properly. These widgets do not collect or store any Personal Information from users on the Site and simply act as a bridge for your convenience in sharing information. Your interactions with these widgets are governed by the privacy policy of the company providing it.
7. Google Analytics.
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of the Site. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.
8. Cookies.
All Racquet Sports uses certain technologies on the Site to collect information that helps us improve your online experience. This notice to California residents supplements the information contained in the ALL RACQUET SPORTS, LLC (“All Racquet Sports”, “we”, “us”, or “our”) Privacy Policy and is exclusively directed to All Racquet Sports’ California clients. B. How to Exercise Your California Disclosure, Deletion, and Opt-Out Rights.
You have the right to request that we disclose to you what Personal Information we collect, use, disclose, and sell, including the right to request that we provide to you the specific pieces of Personal Information we have collected about you in the prior 12 months (“Right to Know”), and you have the right to ask us to delete the Personal Information we collect about you (“Right to Delete”), subject to exceptions set forth in the CCPA. California residents also have the right to opt-out from the sale of their Personal Information. These rights are subject to some limitations, such as when we are retaining data to comply with our own legal obligations. You will not be required to create an account with us in order to submit a request. More information on each of these rights is below.
If you would like to authorize an agent to act on your behalf in submitting a request to know, request to delete, or request to opt-out of the sale of your Personal Information, you may do so by submitting a signed request to us by email at info@allracquetsports.com. Please keep in mind that if we do not receive adequate proof that the agent is authorized to act on your behalf, we may deny the request.
C. Response Timing.
When you request the disclosure to you of the Personal Information we have collected or the deletion of the Personal Information we have collected, we will confirm receipt of your request as soon as feasible but not later than 10 business days. Then, we will typically provide the requested information within 45 days, and we will notify you within that time period if we need additional time to process your request. When you opt out from the sale of your Personal Information, we will honor your request as soon as feasible, but no later than 15 days from the date we receive your request.
D. Your Right to Disclosure.
(i) Making A Request
If you are a California resident and would like to request the categories and/or specific pieces of Personal Information we have collected about you in the prior 12 months, please contact us by email at Info@allracquetsports.com , providing your first and last name and stating the nature of your request.
We will provide the requested information free of charge up to two times in a 12-month period, but please note that when we receive unfounded, excessive, or repetitive requests, we may elect to decline the request. Note also that we will not retain information we do not ordinarily retain in the course of our regular business practices.
(ii) Verifying A Request
Please note that we will take steps to verify your identity in order to fulfill your request.
In order to have us provide specific pieces of information, we will require a signed declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.
If we are unable to verify that the individual submitting the request is the same individual about whom we have collected Personal Information (or someone authorized by that individual to act on their behalf), we will not be able to provide the requested information.
E. Your Right to Delete.
The CCPA also provides a right to request that we delete Personal Information that we have collected about you and for us to direct service providers to do the same, with certain exceptions as set forth in the CCPA. Note that you may also delete certain Personal Information you have provided to us through your online account.
When processing a request to delete, we may erase some information and we may de-identify some information (when we de-identify information, we implement technical safeguards and business processes that prohibit re-identification, business processes to prevent inadvertent release of de-identified information, and will make no attempt to re-identify the information).
(i) Making A Request
If you are a California resident and would like to request that we delete your Personal Information, please contact us by email at info@allracquetspots.com and provide your first and last name and state the nature of your request.
(ii) Verifying A Request
To ensure that we do not delete your Personal Information in response to a fraudulent request, once you submit the request, we will follow up to confirm that you want your Personal Information to be deleted. Please note that we will take steps to verify your identity in order to fulfill your request.
If we are unable to verify that the individual submitting the request is the same individual about whom we have collected Personal Information (or someone authorized by that individual to act on their behalf), we will not delete the Personal Information, but we will process the request as a “Do Not Sell” request.
F. Your Right to Opt-Out of the Sale of Personal Information.
The CCPA also provides a right to California residents to request to opt-out of the sale of Personal Information. All Racquet Sports engages in online advertising practices that may potentially be considered “sales” under the CCPA.
The Site features a “Do Not Sell My Personal Information” link for customers to easily exercise this right.
G. Users Younger than 16.
All Racquet Sports does not knowingly sell the Personal Information of minors younger than 18 years of age without affirmative authorization.
H. Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights.
California consumers have the right to not receive discriminatory treatment for exercising CCPA rights. We will not discriminate against you for exercising your CCPA rights.

2. Other California Rights / YOUR CALIFORNIA PRIVACY RIGHTS.
Pursuant to California Civil Code Section 1798.83, also known as the “Shine The Light” law, California residents who provide us Personal Information have the right to request and obtain from us, free of charge, once each calendar year information about the customer information we shared, if any, with third parties for their own direct marketing purposes during the preceding year. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately preceding calendar year.
We do not share our customers’ Personal Information with unaffiliated third parties for their own direct marketing purposes without your express consent. This notice to Virginia residents supplements the information contained in the ALL RACQUET SPORTS, LLC (“All Racquet Sports”, “we”, “us”, or “our”) Privacy Policyand is exclusively directed to All Racquet Sports’ Virginia clients. This Virginia Privacy Notice sets forth disclosures and rights for Virginia consumers regarding their personal information, as required by the Virginia Consumer Data Protection Act (the “VCDPA”). Terms used in this Virginia Privacy Notice have the same meanings given in the VCDPA, unless otherwise defined.
As a Virginia resident, you have the right to request:
· To know whether or not we are processing your personal data and ask for a copy of your data or information about what we collect, why, and who we share it with.
· That we correct your personal information that is inaccurate.
· That we delete your personal information.
· To opt out of the sale of your personal information and the processing of your personal information for the purposes of providing you with targeted advertising and profiling with significant or legal effects.
A. Right to Opt Out.
Pursuant to the VCDPA, if you are a Virginia resident, you have the right to opt out of the “sale” of your personal information to “third parties”. “Sale” is defined broadly. The VCDPA defines “sale” as an exchange of personal data for monetary consideration by the controller to a third party. This does not just include the exchange of data for money. It also covers any transfer of personal information to a third party in exchange for “monetary consideration”.
All Racquet Sports does not and will not transfer your information to third parties in exchange for money. However, we do transfer personal information to certain third parties in order to operate our business (for example, to market our products and services). Notwithstanding, it is possible that someone could claim that this transfer was in exchange for “monetary consideration”. We want to be careful with and respectful of your information. Therefore, if you opt out, we will not transfer your information to any third party, except as explained below and as permitted by law.
(i) Impacts of Opting Out.
Any transfer of data to a third party may be considered a “sale” of data. The law considers any other business a “third party” unless that business agrees to specific contractual provisions, aligning with the role and responsibilities of “processor” under the VCDPA. We try to get all of the businesses to whom we send information to accept the role of “processor” and agree to the respective responsibilities in our contract. However, not all third-party businesses will or can agree to those terms. As a result, if you opt out of the “sale” of data, All Racquet Sports will not be able to send data to some of our business partners, which could lead to your not receiving all marketing and other information you are accustomed to receiving from us. Further, if one of our partners cannot agree to the special contract language and is considered a “third party”, it is possible that some features of the Site or other services may not work for you after you opt out.
Of particular note is that if you do opt out, we may alert you if a transaction requires a transfer to a third party so that you can opt in if you would like to continue with the transaction.
(ii) Minors.
All Racquet Sports does not “sell” the data of people under 16 and does not intend to collect data related to people who are under 13.
(iii) Opt-Out Exceptions.
The VDCPA creates several exceptions that are important for you to be aware of.
We are allowed to transfer data to a “processor” even if you opt out. A processor is a business that agrees not to use your information for any purpose other than providing the services specified in our contract. For example, if we were to transfer data to business partners to provide data security and detect fraud, those businesses would be “processors”. Even if you opt out, we can continue to transfer data to our processors.
We are also allowed to transfer your data to a third party where you direct the transfer or direct us to interact with the third party. For example, if you direct us to use a specific payment method to pay for your order, even if you have opted out, we will still transfer the data necessary to process your order.
Collecting information and using it ourselves is not a “sale”. Opting out of the “sale” of your data does not prevent us from continuing to collect and process your personal information.
The “opt out” only applies to “personal information”, which is information that is or is capable of being linked to you. We use anonymization and pseudonymization to protect privacy. That data is not “personal information” and opting out will not limit our transfer of that data to third parties.
(iv) Technical Limitations Related to Opting Out.
There are technical limits to our ability to identify data related to you and, if you opt out, to prevent the “sale” of that information to other parties. Where we can reasonably determine that personal information relates to you and you have opted out, we will not “sell” that personal information to “third parties” (except as permitted by the law). However, we may not be able to determine that personal information relates to you. In that case, the information may be “sold” to a third party.
Opting out is not unsubscribe. Opting out of the “sale” of personal information is not the equivalent of unsubscribing from our emails and will not prevent you from receiving marketing messages from All Racquet Sports. If you wish to unsubscribe from All Racquet Sports emails, please follow the unsubscribe link in one of our emails. If you wish to unsubscribe from text messages, please follow the unsubscribe process for the program you opted into. If you would like multiple email addresses opted out, you must provide each address to us. Otherwise, we have no reasonable way to use a single email address you give us to link to other email addresses you may have.
B. Making an Opt-Out Request.
If you would like to opt out of the “sale” of your data, you have several options. You may click the opt out button located below, or you may email us at mailto:info@allracquetsports.com. You will not be required to create an account in order to opt out.
(i) Steps to Follow if You Have an All Racquet Sports Account.
The easiest way to opt out is to “log in” to your account and then click the opt out button. If you do, the email address associated with your account will be opted out, and we will set a cookie on your device to facilitate your opt out. That cookie will enable us to identify you if you return and allow us to prevent data from being “sold”. If you delete the cookie or return using a different device or browser and are not “logged in” to your account, we will not be able to connect the session to your opt out and will not be able to prevent the “sale” of the data.
If you want to opt out using email, you will need to follow more steps. If you want to opt out an email address that is different from the email on your account, you will need to use the email to do so. To use the email to opt out, you or your authorized representative will need to provide us the email address you wish to opt out. We will then send a message to that address. You must reply from that email address to complete the process. This extra step is to authenticate you and prevent fraud and abuse. If you want multiple email addresses opted out, you must provide each address to us. Otherwise, we have no reasonable way to use a single email address you give us to link to other email addresses you may have.
If you email us, we will have no way of setting a cookie on your device. This will limit our ability to prevent the “sale” of data. For this reason, the opt out button is the most complete way to opt out of the “sale” of data.
(ii) Steps to Follow if You Do Not Have an All Racquet Sports Account.

C. Appealing a Decision Relating to a Request.
Should All Racquet Sports deem it necessary to refuse a request, our response will include our reason as well as instructions to appeal the decision. Per the VDCPA, you will need to appeal within a “reasonable period of time” after receipt of the decision. Within 60 days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal. If the appeal is denied, you may contact the Virginia Attorney General to submit a complaint.
